Who Shall Pay the Arbitration Fee

According to Article 74 of the Arbitration Rules of Hangzhou Arbitration Commission, the arbitration fee shall be borne by the losing party in principle; if the parties partially win and partially lose, the arbitral tribunal shall determine the respective proportions of arbitration fee of the parties based on their responsibilities. If the arbitration is settled through reconciliation or conciliation of the arbitral tribunal, the parties may determine their respective proportions through negotiation; in case the negotiation fails or fails to be carried out, the arbitral tribunal shall determine the proportions.

In case the arbitration procedure is delayed and the expense increased because any party fails to keep the principle of good faith or because of other reasons of the party, the party in fault shall bear the relevant expense increased.
