The association was established in Taipei on September 5, 1955 as the first public interest corporation in Taiwan to have a quasi-judicial function in order to arbitrate disputes arising from legal settlements and disputes related to mediation. In the year of 1996, the "Business Arbitration Ordinance" was amended to "Arbitration Law". In order to welcome a new era of arbitration, the Association changed "Chinese Commercial Arbitration Association (Taipei)" into the name "China Arbitration Association, Taipei". A Dispute Mediation Center was also established to promote ADR with legal effect and convenience in the spirit of serving the society.

 

In the past 15 years, the average annual number of cases accepted by the Association has reached 170, including public works, foreign-related commercial affairs and cross-strait economic and trade events. More than 700 local and international lawyers, accountants, architects, technicians and professors from different fields and other professional arbitrators are registered in the arbitrators' roster. The Association may provide services in Chinese, English, or Chinese and English bilingual cases. The arbitration judgments made are subject to enforcement by law and judicial practice at home and abroad.

 

Organization

General Assembly

The general assembly, which is convened annually, has the highest authority in CAA. All important matters of CAA must be passed by the general assembly, including elections of directors and supervisors. It provides a forum for members to share their views on the CAA's operations.

 

Board of Directors/Chairperson

Led by a chairperson elected every four years, the board of directors consists of 31 standing and general directors, who are prominent figures from the legal, business and academic sectors. The board is responsible for formulating and executing the CAA's key policies and objectives.

He or she presides over general assemblies and board meetings, acts as the representative of the CAA, and oversees the Secretariat's day-to-day operations.

Board of Supervisors

The board of supervisors has nine standing supervisors. They are responsible for monitoring the CAA's financial condition, including its spending, budgets, and financial reports.

Secretariat

The Secretariat is headed by the secretary-general who is in charge of the day-to-day administration of all disputes referred to CAA, and carries out the decisions of the boards of directors and supervisors and the general assembly. The Secretariat is divided into 7 divisions: (i) International ADR; (ii) Domestic ADR; (iii) Cross-Strait ADR; (iv) Education and Promotion; (v) Administration; (vi) Finance and Accounting; and (vii) Publication.
