China International Economic and Trade Arbitration Commission (CIETAC) is one of the major permanent arbitration institutions in the world.

 

Formerly known as the Foreign Trade Arbitration Commission, CIETAC was set up in April 1956 as a subordinate to China Council for the Promotion of International Trade (CCPIT) in accordance with the Decision on the Establishment of A Foreign Trade Arbitration Commission in CCPIT adopted on May 6, 1954 at the 215th session of the State Council. To meet the needs of China’s ever-developing economic and trade relations with foreign countries after the adoption of the "reform and opening-up" policy, the Foreign Trade Arbitration was first renamed as Foreign Economic and Trade Arbitration Commission in 1980 pursuant to the State Council’s Notice Concerning the Conversion of the Foreign Trade Arbitration Commission Into the Foreign Economic and Trade Arbitration Commission, and then as the China International Economic and Trade Arbitration Commission in 1988 pursuant to the State Council’s Reply on the Renaming of the Arbitration Commission as the China International Economic and Trade Arbitration Commission and Amendment of Its Arbitration Rules. Since 2000, CIETAC is also known as the Arbitration Court of the China Chamber of International Commerce (CCOIC).

 

CIETAC resolves economic and trade disputes, as well as investment disputes by means of arbitration in an independent and impartial manner.

 

CIETAC is headquartered in Beijing and has sub-commission of South China in Shenzhen, Shanghai sub-commission in Shanghai, Tianjin International Economic and Financial Arbitration Center (Tianjin sub-commission) in Tianjin, sub-commission of Southwest China in Chongqing, Zhejiang sub-commission in Hangzhou, Hubei sub-commission in Wuhan, and Fujian sub-commission in Fuzhou. CIETAC also established its Hong Kong Arbitration Centre in Hong Kong.

 

      

CIETAC and its sub-commissions/arbitration centers constitute a single commission that adopts the same Arbitration Rules and the same Panel of Arbitrators. CIETAC’s Articles of Association clarifies that all sub-commissions/arbitration centers are branch offices to CIETAC to register arbitration applications and administer cases under CIETAC’s authorization.

   

For the development of arbitration business and the provision of arbitration and procedural convenience for the parties concerned, CIETAC has established 29 local and industry offices. To meet the needs for arbitration in a special sector, CIETAC took the lead in China to provide resolutions for parties of different business sectors with arbitration services suitable for them, such as food, commerce, engineering, finance and wool business. CIETAC also provides domain name dispute resolution services for parties and actively explores online dispute resolution for e-commerce. In response to the need to quickly resolve e-commerce disputes and other trade disputes, the CIETAC’s Online Arbitration Rules were launched on May 1, 2009 to, other than the "ordinary procedure", stipulate a "simple procedure" and "quick procedure" according to the scale of the case so as to truly and quickly resolve economic disputes on the Internet.

 

Over the past 50 years, CIETAC has made prominent contributions to the legislation of the Chinese Arbitration Law and the development of the arbitration practice in China. It has maintained relations and cooperation with major arbitration institutions across the world, and has gained a reputation at home and abroad as an independent, impartial and efficient arbitration institution.

 

 

 

 

Organization

 

● Honorary Director, Director, Consultant and Committee

CIETAC has one honorary director and several consultants.

CIETAC consists of a director, some deputy directors and a few members. The director shall perform the duties assigned by the CIETAC Arbitration Rules, and the deputy director may be appointed by the director to perform the duties of the director.

 

● Secretariat

CIETAC has a secretariat mainly responsible for the day-to-day administration of CIETAC and the public legal services that CIETAC are expected to attend, organize and coordinate.

   

●Arbitration Court

CIETAC has an arbitration court that, led by its deputy director and the president of the court, performs the duty of managing cases under the Arbitration Rules. The sub-commission/arbitration center also have an arbitration court and, under the leadership of the president of the sub-commission/arbitration center, perform the duty stipulated under the Arbitration Rules.

  

 ● Special Committee

     There are four special committees under CIETAC:

     - Expert advisory committee

     It is responsible for the research and giving advice on arbitrary procedure and key challenges of entity, providing opinions on the revision of the Arbitration Rules, and the training and view exchanges of arbitrators.

     - Case editorial committee

     It is responsible for editing the previous cases and the composition of the annual publication of CIETAC.

     - Arbitrator qualification committee

     It is responsible for reviewing the arbitrators' qualifications and assessing their performance in accordance with the Arbitration Law and CIETAC Arbitration Rules, and giving suggestions on whether the arbitrators shall be re-appointed or dismissed.

     - Development committee

     It is responsible for the research and giving opinions and suggestions on issues like the development of arbitration.
